So.... you'll give money to the top 3, and take the rest for free?

But I think they mean that only the top 3 will be used!

I noticed this when coming across this jam, and had a similar point of criticism, also this language is a bit vague.

"All Entries become the property of the Sponsor." - which implies that we could possibly not have ownership over the IP at the conclusion of the jam.

"non-exclusive, transferable license" - non-exclusive implies that access isn't restricted to the sponsor.

So would we still have access to developing our concepts further post jam if we don't win any of the offered prizes, and the jam version of our games would be accessible and usable by CoolMathGames for free? Or is the intent that ownership completely transfers to CoolMathGames regardless of the outcome of rankings?

i assume from the wording that the web upload will become their property to do whatever they want with, but that you still have your own version as well? would be really crazy if they completely took any and all rights to the thing you made lol

Yeah I totally agree. I'm hoping we can get a response from a representative from CoolMathGames possibly on this thread to confirm. That's gonna be a huge deciding factor on if I decide to submit to the jam or not.

cause they can't get our source code unless they select us as winners!

they still have the file for a web upload, no?

wait, if only the top 3 gets the prize and the rest of our games get used for free, then they will just have 3 puppet winners that is themselves, and then they will take our games for free!

Whenever the CoolMath Games employee that's been answering questions comes to clarify these parts of the rules, can we also get clarification on whether none US residents (who aren't eligible for the competition) give CoolMath Games the same rights by submitting a game? (I would assume not but would be nice to have some clarification)

seems pretty clear (and unethical) to me. if you submit something to this jam, you are giving them rights to use your game on their website whether you win a prize or not. i would not enter this jam.

does this mean that you simply wont be able to use this submission ever again? you dont own the assets or the game itself anymore? has me kind of worried, i might back out because of that alone.

I will have a weblinked button to completely get my game under my hands , If they misuse I will simply call my api to turn the screen black , and sha for any game is unquie so , its all that you game is safe and prize in hands ;>

Yeah I'm pretty sure you're breaking rules with both coolmath and itch by doing that. If you agree to enter, your submission becomes their property, so you're more than likely violating certain laws by restricting their access or remotely controlling the game.

Hi all, thank you for creating this thread. We apologize for the confusion and would like to clarify.

When you submit a game to this game jam, we DO NOT take ownership of the game. Developers will still maintain all ownership of their games. When we select our 3 winners, we intend to promote those games on our financial literacy page and there will be a conversation of getting exclusivity for it. However, games that are not selected as winners are still the property of the developers.

This portion of the rules is meant to use the games as a way to promote and celebrate the creations from the game jam. When a game is submitted and it abides by our rules, your game will be featured in the Submissions on our game page. We own the submission of the game used in the jam, but this does NOT mean the games become our property. We have no intention of retrieving the source code from the games or taking control of the game's IP in any way.

We hope this helps clear up some confusion regarding the statement.

Coolmath Games has been a thing since 1997. They wouldn't trash almost 30 years of a good reputation to exploit indie devs through a monthlong game jam.
