Collected by itch.io and VAT

Hello everyone,

I am in France and as an individual with a EIN number, I should not pay the VAT so I did fill the "tax" page of my itch.io account. It is said I'll pay not VAT. I must use Collected by itch.io or I'll pay more taxes in France than the price of my game everytime I receive money but it is written :

If using Collected by itch.io, paid later, itch.io will automatically collect VAT from your purchases and file a quarterly report.


So even if I did what I had to not pay the VAT if I choose this option I'll still pay it ?

According to some blogs and news, you only pay VAT if you go over 35,000€ i think this is more talking about PAYE (Pay-As-You-Earn) that was added.  You have EIN so this means you either have employee who work for you or working alone with a company legal work at hand. With EIN you are treated has a company for USA, so there is some confusion to your taxs. I do not know if you are offically a company resigtered with france or a a sole trader (enterprise individuelle or EI).

I need more infomaion, if it is too personal you might want to ask a tax expert. As for what to pick (collect by itch or Direct), i always recommend "collect by itch" because itch is a Merchant of record and itch handles the taxes.

in France I am as an idividual enterprise but I know for sure I don't have to pay my  taxes in USA, including VAT.

I don't pay it on Steam and I used my EIN, same happens here on itch.io it is said I must pay 0% taxes but the description of the "collect by itch.io really disturbs me :
"If using Collected by itch.io, paid later, itch.io will automatically collect VAT from your purchases and file a quarterly report."

If I don't choose this option, I'll pay in French taxes more than the price of my game so I can't do that.

Steam doesn't help with taxes, you are responsable for all taxes on steam, this is the most common thing when developers think they are getting the right infomation but are kinda messing up.

So am just going to assume you have a LLC or something close to a business recognize by the goverment France. You have a EIN so you are somewhere in owning a business with real value. This is not to confuse with sole trader where your stuff is not protected.

Income tax brackets in France for 2019 are as follows:

Up to €9,964: 0%
€9,964–€27,519: 14%
€27,519–€73,779: 30%
€73,779–€156,244: 41%
€156,244+: 45%
You can deduct certain things before calculating tax, which include a 10% deduction for work-related expenses, social security contributions, interest on certain business loans, and French pension contributions.

Those are the tax for LLC for france has far as i know. As well has IRS. You only have to worry about IRS since the threshold is low and Withholding. This is all based on me thinking you own a company with some Value, not an answer to why you might get tax.

It is possable you won't get tax with "Pay by itch" but that doesn't change anything if using "collect by itch". Both are the same, the only diffance is how it was handle.

Thanks for all your research, sorry you spent your time on this I know already how it works on the french side. My only question was about itch.io.
