Had a thought on this:
Gear that is level 1, but has no drawbacks. As soon as it get's leveled to tier 2, bam - drawbacks appear. For the ones that are leveled from tier 1 - random drawback applied.

I may have a better one. initially there's 10% chance of getting an item with drawback. but then slotted items can lose integrity and gain drawbacks
