No, that's not the reason. System 3 can't copyright the 4:1 isometric style. Those involved had things happen that put the project on hold, now working on other titles afaik. System 3 would only try to support people who are serious.

Got my physical copies today, Disk, Tape and Cart, very nice. The LED's on the cart are a nice touch, what would be even better if they tapped into some colour ram somehow to add atmosphere, as well as an option to turn them off, either way it's a nice touch! Awesome game, will play it on my break times.!
