isn't it a better idea to recreate the mario mechanics and physics, ditch the rom and have no potential trouble with nintendo?You could still keep the mario model, and do an easy switcharoo if trouble comes
The rom is up to the user to acquire, whether that be legally or not, so there's nothing Nintendo can do about this fangame
