Try to say it in the curt in Germany, i wonder how big of a fine you will get.

In this case you should ask each creator to publish their terms and conditions. otherwise, a costumer buys without knowing what is allowed to do with the asset.

Itch.io isn't based in Germany, and legal threats reflect poorly on you. Ask the creator if you're unsure. Before buying. Sure, they should have stated terms up front. But it's their problem because you're buying from them. Itch.io is only a marketplace; an intermediary. And sure, it's an idea: maybe our admins could implement a nice reminder, or even stricter checks on asset pages. But then ask nicely. Have a good day.

I would explain you how wrong you are, but im not sure you understand.

I will try shortly-your business may not be in the EU , but your buyers AND Asset creator might... as such, they are subjected to EU laws (or any other non US region). and that is before mentioning Google terms that apply via the play store.

most intellectual property laws are similar in all countries, so if i misuse (the term misuse must be defined as well..) a property i can be sue almost anywhere.

Even the term commercial use must be specify-so if i ask the creator and he tells me something like "Yes" it has no meaning.

Anyway, the same asset that costs here now 5 $ cost by gamedevmarket 11$.

i have to buy it by them because of unclear terms in this website.

Think how much business you lose on that daily. take a lawyer that clarify obligations and rights of costumers.
