My initial thought was that the Windows 95 theme is so minimal, and so much a consequence of "make a DE theme that works with these sixteen colours at this resolution" that it would fall under fair use. Thinking about it more, though, perhaps I'm in more of a grey area than I first thought, so I've tweaked the theme for the post-jam release so that it's evocative, but more distinct.
