Hello,

Yes, you read that right. PowerBobs has been abused - read hacked/cracked - since 2008 and it has always been and remained shareware at the price of €12,39 (back in 1997 = ≈ €23,25 in today’s money) so if you take inflation into consideration the price of €14,99 for a single license and a volume license of €49,99 is just a fair and a dirt cheap price.

All PowerBobs distributions have been fingerprinted, the latest and state of the art protection scheme even today, and I can check even compiled programs for that particular fingerprint.

So yes, there were not 1, not 2 but 3 protection schemes and the fingerprinting has never been hacked and or cracked.
Having worked for financials institutions, IBM and FreeScale semiconductor implementing this state of the art fingerprinting was an easy task.

If you don't agree with the PowerBobs price scheme you must remove all PowerBobs commands immediately from your project or pay for a license (or use the free NAGGING version) and TurboPlusV2.15 has always been free so the above does not apply to it.

Hi,

If anyone wants to buy your currently for sale product, it would be good to know:

- Which version of the plugin is this? The old/original/broken one? (You couldn't show this before.) A newer one? (The original one had a few "bugs")

From our perspective:

-We've been clearing this up for a while now! We made an agreement (which can be followed here on this thread).

-We stuck to the agreement that under the three-point conditions YOU set (which we met and fulfilled), we could freely use the plugins you made (even the cracked/pirated versions, since these were the only ones "available" az that moment). Although we offered to pay for the plugin at the time, you couldn't show us "your own version" and you offered it for free (with "the three rules"). You gave us your approval to use it!

- After the software has been released (free) and already contains the (compiled) plugin you can not change your mind back in time.

Our problem is mostly not with the interpretation of the situation, but rather with the management of the situation, transparency and respect for the (our previous) agreement.

By understanding that (now) you changed our agreement, we can take the following solutions:

- In the future, we will no longer use your plugin in any form in our subsequent possible new applications.

- Since the applications we create and distribute do not contain your plugin (only in compiled form as you requested), we will not delete/change or remove the applicatoon and/or references in the freely available source code. This is our own intellectual property, and no other party has and cannot have a say in this. The source code and application that we (ElectricBlackSheep) have made freely available, downloadable and usable, will not be withdrawn.

The current "situation" concerning PowerBobs, so not TurboPlus since it does not include the SHAREWARE clause in the doc and may be used indefinitely for free, has changed since just everybody is and was taking advantage of the hacked/cracked SHAREWARE version of PowerBobs, as clearly stated in the doc that it is SHAREWARE and supersedes all other declarations.

Facebook Intellectual Property Reports have been filed and have been acceoted by Facebook and the files have already been removed from the groups.

PowerBobs is also protected under the European copyright and GDPR laws and rulings so ANY software that uses PowerBobs has to be retired/removed from the market/marketplace, paid or free versions of the software that uses non legal versions of PowerBobs.

PowerBobs did not have 1 or 2, but 3 protection schemes and the third one is fingerprinting and can be traced in the extension itself or in the compiled code and a complaint will be filed under the GDPR rulings to remove the infringing software immediately from any source available.

Non-compliance or failing to comply will be reported and damages will be imposed to the amount of 1,000 times the price of the volume license.
The legal documents have already been drafted by my lawyer and will be used in the event of non-compliance with the rules stated above.
The payment of a single license or volume license.

Like any written or oral agreement. Not only did you agree, but you were the one who offered us the freedom to use the plugin in our projects. Chronologically, at the moment our application was uploaded, the public agreement still existed.

In this interpretation, you are the one who created the situation by breaking the agreement. It is more like a scamming behaviour! Probably every lawyer and court in existence will see this.

According to this, you have no legal basis to make a claim for the very same reason why you can't take back a car you sell for the money you give to a homeless person.. Please stick to the agreement!

in short term: You cannot ask for something back that you have already given away.

Since you don't use it (ahum) this does not apply to you and "considering it abandonware" = NOT giving the permission to spread the hacked/cracked version. The nagging version still exists, so use that! But you state you don't use it (lol), then you are not affected and are not entitled to give any "advise" on this matter and the doc supersedes all declarations regarding the "reversed engineered" or "denagged version" or whatever hacked/cracked version. The doc clearly states that it is SHAREWARE and even all cracked/hacked versions contain this copyright statement in the doc.
And since I've never spread the hacked/cracked versions the only valid version is the "nagging" one and I never said that the hacked/cracked versions. are the same as the "nagging" version. So the copyright still stands as described in all the docs of all versions.

I am not considering it "abandonware" . At least not anymore!
3 month ago (please read the thread below) I ASKED YOU that specific question:
"Does that mean that we are allowed to use any of your (AMOS) plugins or just this one in question?"

YOUR answer was:
"Yes, ANY of my extensions for Amos and or Amos Pro as long as you or any other user has my consent.
- The cracked Amos/Pro_TURBO_PLUS 2.15 or any other version and PowerBobs (any version) automagically becomes legal when my consent is given and my 3 simple rules are followed."

We agreed and followed the (3) rules you set us! After the agreement I do not have to care about wich version of (any of) the plugin(s) i use. You are playing a dirty game here by allowing and withdraw your consent that happened months ago. This leads to nowhere!
We will not use any your (cracked or not) plugin in the future but the one already built in (two projects) it stay as it is! (as we agreed.)

It would be good to know: I still do not know wich version fo the plugins are you want to sell at the moment? Do you have an up to date version? (Pro_TURBO_PLUS 2.2 or something? ..or is it the cracked one i have to pay for?)

So you have an exemption. Congrats!
You have a single license. Only to be used for your own software.
But this only applies to you and not the software you are eventually spreading using the PowerBobs extension. If so then the volume license price of €49 still stands.

We do not use the powerbob extension in any of our game! If you can you find your "digital signature" you talking about in any of our game then name it? (we will remove it as soon as we can!)

i asked multiple times but you never answered: I still do not know wich version fo the plugins are you want to sell at the moment? Do you have an up to date version or is it the cracked one i have to pay for?

for selling your plugin in a correct way it would be more professional to do it in some marketplace. like here on itch. not on email. it is easier to follow who buyed what product, when and under what rule (if rules changed ower time).
