Dear Mr. Corcoran:

As you know, we are counsel for LEGO Systems, Inc., LEGO Holding A/S, and LEGO A/S (collectively “the LEGO Group”) in this matter involving the unauthorized use of the LEGO Group Properties on itch.io. We follow up on correspondence sent to you on or about July 9, 2025, a copy of which is attached, as well as your response dated October 22, 2025. We renew our clients’ request for the removal of unauthorized uses of the LEGO Group Properties from itch.io and provide additional information herein as requested to assist in this process.

I certify under penalty of perjury that the information in this notification is accurate and I am authorized to act on behalf of the owner of exclusive rights that have been infringed on the pages indicated which may have been posted on Itch.io (the “Website”). I am sending this notification on the basis of a good faith belief that the Website includes infringing material that is not authorized by the LEGO Group, its agents or the law.

Please be advised that the LEGO Group, without waiving any other claims, rights and remedies, transmits this notice in the form specified by the DMCA in the interests of securing expeditious removal of offers that infringe the identified rights only. The LEGO Group does not admit that the DMCA takedown procedure is necessitated in this instance and expressly reserves its rights under the Trademark Act and its remedies under the Copyright Act for all acts of direct infringement and of secondary infringement.

We welcome the opportunity to share with you our experiences in implementing very simple proactive measures to both prevent the misuse of the LEGO Group Properties in connection with your unaffiliated business, products, and/or services in the future, and to also reduce costs for all involved parties in connection with ongoing infringement concerns. We again request your written commitment within ten (10) business days that you will remove all current unauthorized uses of the LEGO® and LEGO® Minifigure Figurine trademarks, as well as any other LEGO Group Properties from your product offerings and marketing materials from your Website. We look forward to your anticipated response and again, would be happy to set up a time to speak with you or someone on your team about how the parties may move forward cooperatively and towards a common goal.

This letter is not a complete statement of the LEGO Group’s rights in connection with this matter, and nothing contained herein constitutes an express or implied waiver of any rights, remedies, or defenses of the LEGO Group in connection with this matter, all of which are expressly reserved.
