(collectively, “Infringing Pages”). The aforementioned use and copying of the Game were not authorized
by our client or its agents. Additionally, our client has a good faith belief that the use of the Infringing Pages
in the manner complained of is not authorized as a matter of law.
As such, this letter shall serve as official notification of copyright infringement pursuant to the Digital
Millennium Copyright Act (”DMCA”) 17 U.S.C. § 512(c)(3) in connection with the foregoing which are
violations of Copyright Act, 17 U.S.C. Section 101, et. seq., which violations subject Itch.io as the host of
the Infringing Pages, to a claim for injunctive relief and damages. Accordingly, please immediately remove
the Infringing Pages and cease any further infringement of the Game in the future.
Please immediately confirm in writing that Itch.io will be complying, and has complied, with this
demand. Please be further advised that if Itch.io does not comply with the demands set forth above, my
Client will have no choice but to institute an action against Itch.io, which action will be prosecuted to the
fullest extent of the law.
I am providing this notice in good faith and with the reasonable belief that my Client’s rights as the exclusive
rights holder are being infringed.
Under penalty of perjury, I certify that the information contained in this notification is both true and accurate
and that I am the authorized legal representative of the owners of the copyrighted material identified above.
