Nintendo definitely does own the Animal Crossing concept and style but usually games companies (and other entertainment companies) allow fanmade works like this to continue because they encourage players to keep playing the game rather than being in competition with it. If you tried to bring out a competitor to Animal Crossing with a similar style, it would be a different story!
