HIIVEMinded Game Assets Terms of Service

Please read these terms of service ("TOS") carefully before purchasing and using HIIVEMinded Assets' game assets. By purchasing and using these assets, you agree to be bound by these terms.

1. Grant of License:
   1.1. Subject to the terms and conditions of this TOS, HIIVEMinded Assets grants you a non-exclusive, non-transferable, worldwide license to use the purchased game assets in your commercial and personal works.
   1.2. You are allowed to modify, edit, or adapt the game assets to suit your projects and incorporate them into your own works.
   
   
2. Restrictions:
   2.1. You may not redistribute, resell, sublicense, or transfer the game assets, whether in their original or modified form, to any third party, including but not limited to other individuals, entities, or websites.
   2.2. You may not claim ownership or authorship of the game assets, in whole or in part, after modifying or incorporating them into your works.
   2.3. In the event that you make extreme edits or modifications to the game assets, to the extent that they are substantially transformed or bear little resemblance to the original assets ("Massively Modified Assets"), HIIVEMinded Assets grants you permission to contact HIIVEMinded Assets for further discussions regarding the potential sales or redistribution of your Massively Modified Assets.
   
   
3. Intellectual Property:
   3.1. All copyrights, trademarks, and other intellectual property rights related to the game assets are and shall remain the exclusive property of HIIVEMinded Assets.
   3.2. Nothing in this TOS shall be construed as granting you ownership or any rights, title, or interest in the game assets, except for the limited license expressly stated in Section 1.
   
   
4. Warranties and Liability:
   4.1. HIIVEMinded Assets provides the game assets "as is" without any warranties of any kind, whether expressed or implied.
   4.2. HIIVEMinded Assets shall not be liable for any direct, indirect, incidental, consequential, or special damages arising out of or in connection with the use or inability to use the game assets.
   4.3. You acknowledge that you are solely responsible for any risks associated with the use of the game assets, including but not limited to compatibility issues, errors, or data loss.
   
   
5. Termination:
   5.1. This TOS is effective upon your purchase and will remain in effect unless terminated by either party.
   5.2. HIIVEMinded Assets reserves the right to terminate this license at any time without notice if you fail to comply with any provision of this TOS.
   5.3. Upon termination, you must immediately cease using the game assets and destroy any copies or modifications in your possession.
   
   
6. Miscellaneous:
   6.1. This TOS constitutes the entire agreement between you and HIIVEMinded Assets regarding the game assets and supersedes any prior or contemporaneous agreements, understandings, or representations.
   6.2. Any failure or delay by HIIVEMinded Assets in enforcing any provision of this TOS shall not be deemed a waiver of that provision.
   6.3. This TOS shall be governed by and construed in accordance with the laws of [Your Country/State].
   6.4. Any disputes arising out of or in connection with this TOS shall be subject to the exclusive jurisdiction of the courts in [Your Country/State].
   
   
7. AI Training:
   7.1. You are permitted to use the game assets for AI training purposes, subject to the following conditions:
   a) The trained AI models can only be used by individuals or entities holding a valid license from HIIVEMinded Assets.
   b) The trained AI models or any outputs generated by the AI models can be used by you in your own works, including commercial works, provided that you properly credit HIIVEMinded Assets as the source of the original training material.
   c) The use of the trained AI models or any outputs generated by the AI models by other individuals or entities requires explicit written permission from HIIVEMinded Assets.
   d) The trained AI models or any outputs generated by the AI models cannot be made public or distributed to other AI models without explicit written permission from HIIVEMinded Assets.
   
   
8. Confidentiality: 8.1. You agree to maintain the confidentiality of any proprietary information or trade secrets contained within the game assets. This includes any data, algorithms, methodologies, or techniques used in the creation of the assets.

By purchasing and using HIIVEMinded Assets' game assets, you acknowledge that you have read, understood, and agreed to be bound by this TOS.
