Welcome to the Practical Media, LLC Memori Art Jam. By entering this Competition, you agree to abide by this End-User License Agreement ("EULA") and the terms and conditions herein. Please read this EULA carefully before submitting your entry.
1.1. By submitting an entry to the Competition, you confirm that you are the original creator of the submitted work and that you own all necessary rights to it.
1.2. You grant Practical Media, LLC a non-exclusive, worldwide, royalty-free license to display, promote, and use the submitted work including, but not limited to, showcasing the work on Practical Media's websites, social media platforms, and in promotional materials.
1.3. You retain all rights to your work, and Practical Media, LLC does not claim ownership of the submitted work.
2.1. The Competition is open to individuals who are 18 years of age or older at the time of entry. By entering the Competition, participants confirm that they meet this age requirement.
2.2. Participants must ensure that their participation complies with local laws and regulations applicable in their jurisdiction.

2.4. Practical Media, LLC reserves the right to disqualify any entries for reasons including but not limited to the jam's age requirement, or applicable local laws.
3.1. Entries will be judged by an appointed panel of judges chosen by Practical Media, LLC. The judging process is subjective and based on criteria such as creativity, originality, and adherence to the theme of the Competition.
3.2. The decision of the judges is final and not subject to appeal. Winning is determined by the judges' discretion and is not quantifiable by direct metrics.
4.1. Practical Media, LLC is committed to protecting your privacy. Personal information collected during the payment process will be used solely in connection with the administration of the Competition.
4.2. By entering the Competition, you consent to the use of your personal information as described herein.
4.3. Explicit Consent: Your submission entry process constitutes your explicit consent for Practical Media, LLC to share your Social Media profile publicly in connection with the competition.
4.4. The sharing of your social media profiles is intended to support promotional activities, enhance visibility of your work, and encourage interaction within the competition’s community.
4.5. You retain full control over your social media accounts and are responsible for any content posted and your individual privacy settings. You are encouraged to review your privacy settings to ensure they reflect your preferences regarding public visibility and interaction.
4.6. Opt-Out Option: If you wish to opt out of having your social media profiles shared, please contact Practical Media, LLC with your request. Please note that opting out may affect the visibility and promotion of your submission in the competition.
5.1. Practical Media, LLC will not be liable for any claims, losses, or damages arising out of or in connection with your participation in the Competition.
6.1. This EULA and the participation in the event are governed by and construed in accordance with the laws of the State of New York, without giving effect to any principles of conflicts of law.
6.2. By entering this Competition, participants agree to comply with all applicable laws and regulations of their own government as well as those of the State of New York. Participants are responsible for ensuring that their participation in the competition is not prohibited or restricted by local laws and that they do not infringe upon any local laws through their participation.
6.3. Any dispute, claim, or controversy arising out of or in connection to this EULA or the Competition that cannot be resolved by mutual agreement shall be resolved in the courts of the State of New York. Participants hereby consent to the jurisdiction and venue of these courts for the resolution of any such disputes.
6.4. Practical Media, LLC makes no representations that the Competition is appropriate or available for participation in locations outside of New York, and accessing the Competition from territories where its contents are illegal or unlawful is prohibited. Participants accessing the Competition from locations outside New York do so on their own initiative and are responsible for compliance with local laws.
7.1. Practical Media, LLC reserves the right, at its sole discretion, to amend, modify, add, or remove portions of this EULA at any time without prior notice. Any changes will be made through this itch page.
7.2. It is the participant's responsibility to check this EULA periodically for changes. Your continued participation in the "Memori Art Jam" following the posting of changes to this EULA or competition-related information will mean that you accept and agree to the changes.
7.3. Practical Media also reserves the right to modify, suspend, or discontinue the Competition (or any part or content thereof) at any time with or without notice to you, and Practical Media will not be liable to you or to any third party should it exercise such rights.
