My project for this summer is to explore the feasibility of running a game development studio.    

I’m very much coming at the thing from an organization management perspective, and so learning the exact difference between the studio, a developer, and a publisher, has been a fascinating experience.    

One of the activities that ends up blurring that sort of line is purchasing game assets, rights and rights to revenue.   And I was wondering, first of all how the itch.io platform works, and if this is just in one of these little menu bars that I haven’t seen, or if there’s some sort of reputable third-party market that’s well known. That sort of thing. 

But also more generally about, just the practice itself. Is it normal and ethical to buy somebody else’s old project, and either market it as is, or continue development on it for the same purpose?  Seems to me a sensible way of building up a catalog for a studio that is just starting out. Don’t reinvent the wheel and all of that.  

I appreciate your input, and I hope this is in line with the rules and everything.   Thank you.

  1. It might not be so easy for Hasbro to sue everyone else into compliance as they seem to think, for a lot of little legal reasons.
  2. It will give people an incentive to let D&D go the way of Harry Potter, and deservedly so.

But in the mean time, it's a mess, and will impact a lot of creators, including right here. That's why we can't have nice things.

After seeing discussion about setting prices for our games to bring up the value of all indie games (thanks RPG Design Friends), I priced my two previously PWYW games to a minimum of $2. I also have a way for folks to email me for a free copy, and the screenshots on the pages of both games have them in their entirety. I thought about making the text versions free and the pdfs priced, removing some of the screenshots, etc. but this is what I settled with.

Does this sound sensible? I want to both value my labor (and the value of other indie creations) and make my art accessible to everyone. How do other folks accomplish this?

This sucks, but luckily they're grandfathering in everyone with a Patreon account at the old rate. These changes aren't happening just yet, so I highly recommend making a Patreon right now if you're at all interested in using the service for your games, writing or whatever, even if you have nothing to post yet. Your account should maintain its Founder status and you'll get the better rate when you do start producing content.

https://itch.io/t/423346/changes-to-us-copyright-process-as-of-3419Changes to US Copyright Process as of 3/4/19https://itch.io/t/423346/changes-to-us-copyright-process-as-of-3419Thu, 21 Mar 2019 02:42:33 GMTThu, 21 Mar 2019 02:42:33 GMTThu, 21 Mar 2019 02:42:33 GMThey and hello y'all'ins. so this probably won't apply to most folks and a lot more just won't care and that's fine, but i thought i'd bring some attention to a recent SCOTUS ruling that has (or at least will) fundamentally changed the way copyright works in the states, which in turn likely means any other countries participating in the WIPO treaty and Berne conventions. to start, i'm not a lawyer and if you're dabblin' in the black legal arts and you can afford it, you should get a lawyer. you can also go to your local legal aid society for free/cheap help but they rarely do IP law stuffs, but its always worth a check.

at any rate, prior to march 4th basically all you had to do to own your IP is make the damn thing. that's still true, however, courtesy of Fourth Estate Public Benefit Corp. v. Wall-Street.com you now must have registered your copyright with the libary of congress before you can commence a lawsuit against some n'er do well. not only must you have registered your copyright, the LOC must have processed the application. this is a game changer, because it contradicts the literature of the copyright act as well as prior SCOTUS rulings. it also means that there will be heavy pressure on the registrar as it takes some 8 to 10 months to process an application already; it'll go up.  Jordan Franklin has a pretty good opinion piece you can read here, and she IS a lawyer. her point about is statute of limitations is on point, which i think is extremely relevant to the sort of re-discover-ability that RPGs tend to have.

so that's something to watch out for! again, i am not a lawyer and this is not legal advice, but i keep up with IP law pretty hard because i do art/game stuffs for other people a lot and sometimes you gotta know some legal stuff. if anyone has any questions i can try to answer as best and non-legally binding as i can, or point you to a better resource.
